Boston, MA, Oct. 26, 2011 – Kotchen & Low LLP and its co-counsel have moved for preliminary approval of an $82 million settlement on behalf of a class of local government entities who were allegedly overcharged for prescription drugs by defendant McKesson Corporation, the country’s largest drug wholesaler.

The class, certified on March 4, 2011, alleges that McKesson fraudulently inflated certain prescription drugs’ “Average Wholesale Price” or “AWP,” a benchmark that was widely used to determine the reimbursement price for many prescription medications. The proposed settlement includes an express denial of liability of any kind by McKesson.

The named plaintiffs are the Board of County Commissioners of Douglas County, Kansas; the City of Baltimore, Maryland; the City of Panama City, Florida; Anoka County, Minnesota; the City of Columbia, South Carolina; and the City of Goldsboro, North Carolina.
