San Francisco, CA, Sept. 12, 2025 – Kotchen & Low filed a class action discrimination suit against Tesla, alleging that Tesla favors foreign H-1B visa workers over Americans, in violation of 42 U.S.C. § 1981, which prohibits citizenship discrimination.

Plaintiffs Scott Taub and Sofia Brander represent the class. Taub is a tech worker who alleges that he received an e-mail from a third-party recruiter for a position that he was interested in, but the email stated that the Tesla position was for “H-1B only.” Both Taub and Brander applied for Tesla positions, but were not hired after disclosing that they were U.S. citizens.
